1. Introduction

Greetings from UniversalDataHaven ("us," "we," or "our"). Your usage of our website at universaldatahaven.sbs and yacht charter services (hereafter referred to as the "Service"), provided by UniversalDataHaven, is subject to these Terms & Conditions ("Terms").

You consent to comply with these Terms by reserving a charter or by using our Service. Access to the Service is not granted if you do not accept any part of the terms.

2. Service Overview

At UniversalDataHaven, we offer luxury yacht chartering services, which include but are not limited to:

• Yacht hires for the day
• Evening yacht voyages
• Company getaways
• Events held privately
• Extended yacht charters

Our services are contingent on vessel availability and weather conditions. We retain the authority to alter or discontinue any service without prior notice.

3. Booking and Reservations

3.1 Booking Process

To reserve a yacht, you are required to:

• Attain a minimum age of 18 years
• Supply precise and exhaustive details
• Remit the necessary deposit as noted in the booking confirmation
• Consent to these Terms & Conditions

3.2 Confirmation

Confirmation of your booking occurs when we issue a written acknowledgment and receive your payment. Service provision is subject to our discretion, and we may deny service to anyone.

3.3 Availability

The availability of charters is dependent on the readiness of the vessel and suitable weather forecasts. We shall strive to accommodate your scheduling preferences.

4. Payment Terms

4.1 Pricing

All listed and discussed prices are denominated in € and are inclusive of relevant taxes unless declared otherwise. Price modifications may happen without prior announcement.

4.2 Payment Schedule

• Deposit: A requisite 50% of the total cost for chartering, payable during booking
• Remaining Balance: To be settled 48 hours in advance of the charter’s departure
• Incidental expenses (if applicable): Payable upon the conclusion of charter

4.3 Payment Methods

We welcome payments via major credit cards, bank transfers, and certified cheques. Our encrypted, secure systems manage payment procedures.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• If cancelled more than 72 hours prior to departure: Entire refund excluding payment processing fees
• If cancelled between 24 to 72 hours before departure: 50% refundable
• If cancelled with less than 24 hours to departure: Non-refundable

5.2 Weather Cancellations

In the event of weather conditions deemed unsuitable by our captain, we will propose to:

• Reschedule the charter to another available date at zero extra fee
• Process a complete refund if rescheduling proves unfeasible

5.3 Mechanical Issues

Should there be a mechanical failure with the dedicated vessel, we'll attempt to provide a comparable alternative or issue a full refund if none is available.

6. Safety and Conduct

6.1 Safety Requirements

All travellers are expected to:

• Heed instructions given by the crew
• Utilize safety gear as instructed
• Declare any health conditions that could influence their safety
• Stay within permitted areas on the yacht

6.2 Prohibited Items

The following articles are not allowed on board:

• Containers made of glass
• Illicit substances
• All kinds of weapons
• Excessive amounts of beverages (beyond reasonable personal consumption)
• Pets (except with prior consent)

6.3 Conduct

Visitors are expected to behave respectfully. The charter may be terminated without refunds if the conduct of anyone aboard represents any risk to safety or interferes with the enjoyment of other guests.

7. Liability and Insurance

7.1 Our Liability

Our liability is confined to the payment received for your charter booking. We are not responsible for the following:

• Injuries sustained due to guests' negligence
• Lost or damaged personal belongings
• Indirect or punitive damages, or consequential losses
• Delays occasioned by weather or events out of our control

7.2 Insurance Coverage

We sustain comprehensive insurance policies for our yachts and operational activities. Responsibility for obtaining travel and personal insurance lies with the passengers.

7.3 Assumption of Risk

Engaging in our charter services implies acknowledgement and acceptance of the inherent risks associated with marine activities. Responsibility for personal safety is assumed by the participant.

8. Modifications and Itinerary Changes

We retain the authority to alter travel plans, schedules, or routes due to concerns over weather, safety, or operational demands. We will endeavour to provide appropriate comparable alternatives whenever possible.

9. Force Majeure

We are absolved from responsibility for any delays, cancellations, or changes brought about by events beyond our command, including but not restricted to:

• Extreme weather
• Natural calamities
• Governmental decrees
• Port shutdowns
• Mechanical breakdowns

10. Privacy and Data Protection

Your personal data management adheres to the guidelines set forth in our Privacy Policy. Utilization of our services denotes consent to our data collection and usage as outlined.

11. Intellectual Property

Our web content, including texts, images, logos, and graphics, is safeguarded by copyright and trademark legislations. Duplication, distribution, or creation of derivative works without our written consent is prohibited.

12. Governing Law

The enforcement of these Terms is subjected to the laws of Monaco. Any dispute resolution will be undertaken in the courts within Monte Carlo, Monaco.

13. Changes to Terms

We reserve the authority to update these Terms as necessary. Any amendments will be broadcasted on our website, with the revision date noted. Your continued use of our services signifies agreement to the new terms.
